| Last year my son was in an accident, rear ended by an elderly lady. -She admits fault
-She is issued a citation for failure to control speed and following too closely
-In spite of being cited she claims it is not her fault and that my son stopping too quickly caused the accident, even though he was not even moving (stopped at a stop light)
-Her insurance denies claim
-We file claim with our carrier, have to pay $500 deductible. They say they will then recover from her insurance company Result; they are not able to recover. BUT... GET THIS.. We were both covered by the same company; ALLSTATE! IMHO this was a situation where ALLSTATE won on both counts and denied our claim against her simply to save money. Yes, we switched carriers shortly thereafter.
